Black Day

URGENT MESSAGE FOR All members

Dear Members,
In continuation with our Letter No.IMD/NGSSA/13/2008 dated 18-02-2008 pertaining to Memorandum of Demands and observing of countrywide Black Day protest, the CEC of the Association had a meeting with the new DGM AVM, Dr.Ajit Tyagi along with Sh.R.C.Bhatia and Sh.Vijay Singh, Director on 18-3-2008 at 1630 hrs in his chamber.
The representatives of the Association apprised DGM about the main grievances of the Scientific/Technical employees of the Department which is badly affecting their career prospects and welfare measures.
The DGM gave a patient hearing on the views/suggestions of the Association and assured that whatever is feasible within the ambit of the rules, he will certainly try to address the grievances judiciously. He also assured that he will vigoursely pursue the case of the S.K.Das Manpower Re-structuring Committee report with DoP&T along with Secretary MoES and regularization of ad hoc posts in IMD. DGM assured that he will ensure that DPC is conducted at regular fixed interval as per DoP&T norms and directed that Grievances cell/Recruitment cell be formed .The minutes of the said meeting is expected shortly and the same will be circulated to all members.
Keeping in view the assurances of the DGM, the CEC of the Association has decided to defer the countrywide protest from 19-20th march 2008 and observing of black day on 24-03-2008.

Memorandum of Demands

Sub: Memorandum of Demands.
R/Sir,
Consequent upon G.B.Meeting of the Association held on 12-02-2008 at Seminar Hall, N.Delhi and the comments/inputs received from all Regions, the following proposals were passed unanimously for your kind intervention:

1. To expedite implementation of S.K.Das Manpower Restructuring Committee report in IMD considering the proposals of all Recognized Associations of IMD.
2.The Committee under the chairmanship of Shri S.K.Banerjee, ADGM (H&A) constituted to review additional Scientific workforce required in IMD for implementation of various plan schemes under Modernization of IMD, has mentioned the proposal of only one Association under para 7.9(page 32) whereas there is neither any mention about the proposals submitted by other recognized Association of the Deptt nor their views/suggestions taken care of, thus defying the mandate for which it was constituted. The said committee has unilaterally proposed on page18 to convert 693 vacancies (due to retirement upto March, 2012) of AM-I and below be converted to 500 posts of the level of Met Grade I (Scientist Gr-B) which this Association strongly oppose because there is acute stagnation in the foundation Scientific & Technical cadres where the promotions are vacancy based. The Sanction strength (as on 01-04-2007) from L.A. to AM-I is 4441 and the Men in position is 3505. The foundation Scientific & Technical cadres are already under-staffed/short by 936 posts (as on 01-04-2007) as there is no recruitment for more than decades time, the said manpower will further deplete by 1629 posts till 2012. As a result of this, not only the workload on foundation Scientific & Technical cadres have increased manifold but also, their transferability factor. All vacant posts in different regions be immediately filled –up.
3. To immediately regularize all 728 S.A/AM-II ad-hoc posts in IMD.
4. As per existing R/Rules, there is common seniority for promotion to Scientific- Assistant (Senior Observer & Draughtsman in the ratio of 1:38), Assistant- Meteorologist Gr-I [Assistant Meteorologist Gr-II & Assistant Meteorologist Gr-II (Foreman)]; the same should also be applicable for promotion to Meteorologist Gr-I (in the cadre of Assistant Meteorologist Gr-I and Meteorologist Gr-II in the ratio of 80:20).
5. IMD employees serving in Airports/Ports should get facilities at par with AAI/Port officials.
6. DPC should be conducted at regular fixed intervals as per DOP&T norms.

The employees are aggrieved and frustrated due to continued negligence of their career and welfare prospects by the management for more than four decades. As a result, majority of the employees are compelled to seek legal remedy for even petty matters, which can be resolved with timely intervention and follow-up action. With bleak promotional avenues and adding a tag of ad-hoc on promotion with transfers (for more than four years), the employees feels more humiliating than punishment for no fault on their part and prefers ACP rather than promotion.
This Association has submitted several representations to all concerned competent authorities and met Hon’ble Minister in charge and Secretary MoES apprising about the ground realities of the employees, but the status quo persists till date. Due to continued resentment, it has been decided that all employees will initially express their peaceful protest country wide by wearing black bands/badges from 19th-20th March, 2008 and WMO Day will be observed as a BLACK-DAY on 24-03-2008(23rd March, 2008 being Sunday). If the Administration does not pay any heed to our genuine demands, than other means of protest will be explored.

Considering above facts, you are requested to apprise this Association about the status and action taken on the above points (in writing) in order to communicate the same to all members.

EMPLOYEE'S CONFIDENTIAL REPORT

Rejecting government's submission that an annual confidential report (ACR) is sacrosanct, the Punjab State Information Commission has in a landmark verdict upheld the right of an employee to have access to his or her ACR.

An application moved by Faquir Chand Sharma, an office superintendent in the Public Works Department (Buildings and Roads), to his executive engineer for supply of copies of his ACRs for six years - from 2000 to 2006 - under the Right to Information Act (RTI) was rejected on the plea that the information sought was exempt from the purview of the RTI Act.

Aggrieved Faquir Chand preferred an appeal before the State Information Commission by raising a pertinent issue as to "whether an employee is entitled, under the RTI Act, 2005, to have access to his or her ACR or not."

Though the appeal was initially listed before State Information Commissioner (SIC) R.K. Gupta who subsequently desired that a Full Bench of the commission dispose this appeal, as its decision would have far-reaching implications.

A Full Bench comprising Rajan Kashyap, R.K. Gupta and Surinder Singh was constituted with Brij Mohan Lal, an advocate, made amicus curiae. Additional Secretary, personnel of the Punjab Government, too appeared on behalf of the executive engineer. The order, issued on November 5, has been posted on the website of the commission.

It was argued that information in an ACR was held by the state in a fiduciary relationship, and, therefore, in terms of the RTI Act, unless larger public interest warrants to the contrary, it was exempt from disclosure.

Further, it was argued that the information sought was personal and had no relationship to public activity. Further, an order of the Central Information Commission as well as federal instructions that the ACRs are not to be communicated or shown to the officer concerned except to the extent of communicating any adverse remarks were also made for denying the application.

The Full Bench held that the rules and instructions have to give way to the legislative command. Further, the RTI Act, the bench held, was a progressive measure aimed at bringing about greater transparency in the working of the government.

"In our view keeping officials informed about how their superiors assess their performance would only result in improvement in the overall work environment," the order said.

"We are convinced that permitting the disclosure of ACR entries to the employee concerned would lead the reporting officers to be more fair and objective in their assessment. This would lead to overall betterment of the morale of the employees and a consequential improvement in the administration," the order said.

Ammendment of RR of AM-II



Dear All,
Sometime ago,I have made one RTI application to UPSC requesting them to inform me about the status of approval from UPSC regarding ammendment of RR of AM-II.UPSC has informed me vide their letter no.F. No.2/30/2006-RR dated 31.01.2008 that the matter is under process and can be processed only after receiving the reply from IMD w.r.t UPSC letter no. F.No.3/39(I)/2006-RR dated 22.01.2008 . In fact UPSC has agreed to process the case by adding a note of 100% promotion to AM-II cadre and the note should be restricted upto 5 years.Once adhoc, AM-II are regularised, automatically the adhioc SA will be regularised.Scanned copies of correspondences attached for ready reference.

Sub: Re-structuring and Modernization of India Meteorological
Department –Revival of JCM scheme in the Deptt.

You may be aware that one Prof. Narasimha Committee has been constituted by the Ministry of Earth Sciences for re-defining the mandate of IMD, NCMRWF, IITM and re-structuring of IMD. It is learnt that five committee(s) under different subject are constituted including Modernization & cadre re-structuring of IMD, which is expected to finalize its report very soon.
Both IMD Administration and our Administrative Ministry are not consulting any recognized Union/Association(s) on important policy matters due to defunct HQ Council (JCM). The S.K.Das Administrative Re-structuring Committee bears the testimony to the fact that till date it has neither called for any inputs/suggestions from any recognized Union/Association(s) officially nor have apprised about approved structure. Many efforts in this direction has borne no fruits because in all these years JCM scheme has taken a backseat and the employees are compelled to seek relief through court of law even on petty matters. Even after three decades the Group ‘B’, ‘C’ & ‘D’ cadres are contesting to bring them at par with similar placed persons in other Central Govt. Deptt.
Keeping in view the state of affairs of IMD employees, It is earnestly requested to all the CEC representatives of the recognized Union / Association of the Department to discuss this burning issue in a meeting on 26th October, 2007 (15:00 hrs) at Association’s Chamber No.3 and to revive the JCM scheme in the Department which has become defunct since 1997. As per DOP&T O.M. No. 3 / 42 / 87-JCA dated 25th January 1988, whenever there is a scheme/proposal for introduction of new technology in a Ministry / Department, the staff side in the concerned Deptt. Council is consulted before taking a final decision in the matter.

Verification of membership of Service Association.

Sir,

Kindly refer to your letter cited under 1st instant requesting this Association for provision of list of DGM (HQ) members of the Association for deduction of membership subscription for the year 2007-08 and your subsequent letter under 2nd instant intimating that on re-verification of membership, it was found that this Association commands less than 35% of membership. Both the letters are contradictory to the fact that on one hand, the office is insisting on the membership list of DGM (HQ) from the Association whereas on the other hand re-verification of membership is conducted without bothering to update the database of DGM (HQ) /DDGM (UI) / RMC New Delhi for the year 2007-08. The data compiled by the office seems to be erratic and inconsistent.
This Association has called for membership list of all Regions (New Delhi, Mumbai, Kolkata, Chennai, Guwahati, Nagpur & Pune) from our Regional Secretaries, which is expected shortly. Meanwhile, you are requested to provide the following data to remove inconsistency in re-verification of membership. In order to have a credible database, the following checks are must. In this connection, the following is submitted:
The reply to this Association’s letter No. IMD/NGSSA/01/2008 dated 31-12-2007 in response to your letter under 1st instant is still awaited.
It is noticed that the list of membership of DGM (HQ) does not reflect the members of this Association from CSO Shillong and PAC Kolkata, which comes under DGM’s office. Also, the list of membership of DDGM (UI) / RMC New Delhi does not reflect the members this Association from Hydrogen Factory, Agra / FMO Agra. In order to have proper records, all this missing data had to be called from respective stations and incorporated in records.
The members who opt for alteration or withdrawal of membership in the month of March of every financial year, their membership is updated in respective Association/Union as per the Check-Off-System in pay-rolls and the persons who had not opted remains in their respective Association/Union. But, the persons who are posted/transferred from one establishment to another, though their Last Pay Certificate (L.P.C) is sent to respective office but, their membership affiliation to a particular Association/Union is not passed on to respective office.
In order to co-relate and re-verify the office data with our data from all Regions, it is requested to arrange provision of following data on priority basis:
· Total strength and men in position of all Non-Gazetted cadres comprising of Group D, Admin, Scientific/Technical Cadres (Non-Industrial Mechanical Cadres) as on 30-04-2007.
· Total strength and men in position of Non-Gazetted Scientific/Technical cadres comprising of L.A., S.O., S.A., Non-Industrial Mechanics, Draughtsman, Librarian as on 30-04-2007.
· Region wise strength and men in position of Non-Gazetted Scientific/Technical cadres members affiliated to this Association as on 30-04-2007. The data should include all data as mentioned in Para 2&3 above.
It is therefore requested that above data may be provided to the Association on priority basis before submitting the case for further recognition of the Association.

Subscription Deduction

DGM’s Office-inordinate delay.
Ref: DGM Letter No. B-12017/1/06-E (3) dated 26-12-2007.
Sir,
Kindly refer letter cited above pertaining to provision of list of DGM (HQ) members of
the Association for deduction of membership subscription for the year 2007-08. In this connection, the following is submitted:
1. The Association till date does not supply the list of members because every year as per routine practice, the members have option for new membership/alteration/withdrawal of membership. Many members comes out of the purview of the Association on getting promotion to Gazetted cadre. Besides this, many members on promotion are transferred/posted to other RMCs or sub-offices during a calendar year. All this data is available in Establishment Section only.
2. New membership/alteration/withdrawal of membership of Unions/Associations is a routine exercise being conducted since 1997 in the month of March of every financial year under CCS (RSA) Rules 1993. The said exercise ends up in the last day of March each year so that the deduction of membership subscription is made effective from April of next financial year.
3. Though the membership subscription should be deducted from the salary of April onwards each year but it is inordinately delayed. It is regretted that though presently, DDGM (UI) Office and RMC N.Delhi Office had belatedly deducted membership subscription but DGM’s Office has not completed this routine exercise even on ending of year 2007(i.e. even after 08 months time).
It is therefore requested that membership subscription of Association in r/o DGM’s Office be deducted immediately and the responsibility on the part of erring official be fixed for inordinate delay in executing DOP&T ‘s guidelines in the matter.
