INCOME TAX EXEMPTION ON GRATUITY

The government has hiked the limits of gratuity payment from Rs 3.5 lakhs to Rs 10 lakhs.
This enhanced limit is applicable to employees who retire, become incapacitated before retirement, expire or whose services were terminated on or after May 24, 2010.
As per Section 10(10) of Income Tax Act, gratuity is paid when an employee completes five or more years of full-time service with the employer.
In respect of government employees, any death-cum-retirement gratuity received under the pension rules or scheme of the central or state government, or regulations applicable to the members of defence services, is not taxable.
In case of gratuity received under the Gratuity Act, 1972, any gratuity received to the extent that it does not exceed an amount calculated in accordance with the provisions of the Gratuity Act is not taxable.
For employees receiving gratuity other than under the government pension or gratuity scheme and also other than under the Payment of Gratuity Act, the computation mechanism in respect of exemption limits has been specified in the IT Act.
The Central Board of Direct Taxes (CBDT) has issued a notification increasing the overall tax exemption to Rs 10 lakhs.
The gratuity received by an employee is not taxable if it is received on his retirement, his becoming incapacitated prior to such retirement, termination of employment or if such gratuity is received by his widow, children or dependants on his death.
Further, such gratuity does not exceed one-half month's salary for each year of completed service, calculated on the basis of the average salary for 10 months immediately preceding the month in which such retirement or death takes place, subject to the limits prescribed by the central government.
Salary for this purpose includes dearness allowance, but excludes all other allowances and perquisites. Also, as per some judicial precedents, completed service would mean a total period of service whether under one employer or more. In case any such gratuities are received by an employee from more than one employer in the same financial year, the aggregate amount so exempt should not exceed the overall exemption limit.
Similarly, if gratuities were received in one or more financial years, the exempt amount claimed earlier has to be taken into account while computing the exemption at present.
What is gratuity?
Gratuity is a retirement benefit. An employer may offer gratuity out of his own funds or may purchase a group gratuity plan from a life insurer. In case the employer chooses a life insurer, annual contributions as decided by the insurer have to be paid. The gratuity paid by the insurer will depend on the terms of the group gratuity scheme.

AT 0900 UTC ON Feb 11 THE TROPICAL STORM 'BINGIZA' LAYED POSITION NEAR 14.2 South LATITUDE AND 53.7 East LONGITUDE, WHICH WAS EARLIER QUASI STATIONARY. IT WILL SLOWLY INTENSIFY, THE MAX WINDS AT PRESENT ARE 80Kmph. A LARGE AREA OF THUNDERSTORM IS IN OPEN WATERS AND THE TEMPERATURES IN THE TOP REGION OF THE CLOUD WERE LESS THAN -50 deg CEL. THE DEEPEST CONVECTION FROM THE LOWER LEVELS MAY BECOME WEAKER IF PARTIALLY EXPOSED AND BECAUSE OF WINDSHEAR MAY MOVE NWly(MEASURED FROM THE CENTRE OF THE STORM) BECAUSE OF AN UPPER LEVEL TROUGH (AN ELONGATED AREA) OF LOW PRESSURE. BELOW IS AN IMAGE AT 0630 UTC OF Feb 10.

THE ENTIRE WEEK STARTING TOMORROW MONDAY THE 14 Feb OVER NAGPUR WILL BE CLOUDY. THE SWly WINDS UPTO 600 mb AND WSWly WINDS AT 500 mb WILL BRING IN SOME MOISTURE AND RESULT IN THUNDERSTROM ACTIVITY IN THE WEEK END ON SATURDAY THE 19th. The next time you swipe your debit card at a petrol bunk, use a credit card to buy a movie ticket or pay a bill online, do it at your own risk.
A new survey of security in Indian banks has revealed that many of them do not follow even basic measures to ensure card security or protect your personal information. The survey finds that banks in India lag in security of cards transactions.
"Against the backdrop of well known global cases of card breaches, it is surprising to note that basic measures for ensuring card security have not been adopted by many of the banks," points out the survey done by the Data Security Council of India and KPMG, under the aegis of CERT-In (Computer Emergency Response Team), the cyber security wing of the ministry of information technology.
In all, 20 public sector, private and foreign banks were surveyed and their chief information security officers (CISOs) interviewed for the study.
The survey found that banks still follow highly risky practices such as storing and printing authorisation information like CVV numbers and expiry dates, and non- masking of card numbers. Merchants are allowed to create card records in plain text. All such practices followed by banks are "non- conformant to globally accepted practices for card security," the survey report states.
Most banks have put in place security provisions such as SMS alerts, a separate transaction password and a virtual keyboard for online banking, but this is not enough. According to the study, the banks have still not introduced features that will make card transactions secure such as one-time-password (a dynamic token), an identity grid and risk-based authentication.
Such additional security features are necessary because in an electronic card payment system, data is directly accessed and processed by customers, service providers as well as other partner institutions. While an integrated environment like this has made the banking experience smooth for customers, it has introduced new risks.
The survey says that while most banks enforce basic 'hygiene factors' like enforcement of password policy, password change at first login, account lockout and session timeout, some of them do not enforce expiry of password after a stipulated time. Technology systems in 37 per cent of surveyed banks require download of external applications or mobile code, which increases vulnerabilities.
Most CISOs interviewed felt that managing security of online banking remained challenging task. When it comes to privacy of customer data, the scenario is worse.
Though the IT (Amendment) Act, 2008 has provisions for privacy of data, concrete systems for customers' privacy protection are yet to be implemented by many banks, the study says. Almost 80 per cent of the banks surveyed did not have a separate privacy function. Three-quarters of the banks surveyed had security teams comprising less than 10 people.
Survey results indicate that banks are constantly being exposed to sophisticated, organised and financially motivated threats and customers are being targeted through phishing, vishing and smishing attacks.
Yet banks don't have mechanisms in place to track fraud and continue to largely depend on incidents being reported by customers and employees.
Internal management systems of banks are also not fully geared for the digital age. "Information security has no or minimal role in fraud management. The silo in the security and fraud management role would lead to a significant gap in banks' effort to curb financial frauds as security compromises are seen as a tool for committing financial frauds," the study says.
Information security is still seen as an IT-centric function, in contrast to global trend of positioning security as an important corporate function. The only silver lining, according to the study, is that most banks have in place appropriate protocols to ensure security of payment gateways.
Banks also encrypt card numbers and other confidential data during storage and transit. "The significance of data protection and privacy has been underscored in the IT Act, but understanding of this issue in many banks is still lacking," said Dr Kamlesh Bajaj, chief executive officer, DSCI.
"Banks also need to understand the key role chief information security officers should be made to play in their overall business strategies." Lack of adequate security and data protection measures can make customers vulnerable to attacks from fraudsters and could result in hacking or misuse of their bank and credit card accounts.
The survey reveals that banks do not feel constrained due to inadequate budgets or technical skills for information security. But they seem to be neglecting security issues due to 'increasing omnipresence of banking services and endeavour to enhance customer experience', the report notes.
Banks must align internal policies, procedures and deploy technology safeguards for protecting sensitive personal information, it is suggested.
Survey results reveal that understanding of data privacy in the banking sector is growing with over half of the respondents being aware of privacy principles and roles and entities for data protection.
However, data privacy has not yet fully permeated into the banking sector. Implementation of specific measures like formulation of privacy policies, privacy impact assessments and embedding of data privacy in business processes have not gained significant traction, the report pointed out.
With the customer base of banks growing, the study says, it is the responsibility of banks to make consumers aware of security issues. Some banks have launched media campaigns, but more needs to be done.

IN INDIA, THE EARLIEST METEOROLOGICAL OBSERVATIONS SEEM TO HAVE BEEN MADE BY “GOLDINGHAM” IN MADRAS (now CHENNAI) AND GOT MUCH APPRECIATION AND “ASIATIC SOCIETY OF BENGAL” WAS FORMED IN THE YEAR 1784 BY SIR WILLIAM JONES.
THE METEOROLOGICAL OBSERVATIONS RECORDED AS EARLY AS 1793 WERE SYSTEMETAICALLY RECORDED BY PREPARING A METEOROLOGICAL REGISTER IN 1796. THERE WAS NO PROPER SCIENTIFIC USE OF THESE OBSERVATIONS FROM 1796-1860. IN 1857, ACTING ON THE PROPOSAL OF ASIATIC SOCIETY, Col.R STRACHEY THEN APPOINTED A COMMITTEE, WHICH SUBMITTED IT’S REPORT IN 1862 AND HIGHLIGHTED THE IMPORTANCE OF UNIFORMITY IN Met. OBSERVATIONS. RECOGNIZING THE VALUE OF REPORT, THE BRITISH GOVERNMENT THEN ESTABLISHED THE METEOROLOGICAL DEPARTMENT IN 1875, UNDER THE MINISTRY OF REVENUE,AGRICULTURE & COMMERCE, AND Mr. H F BLANFORD WAS APPOINTED AS THE FIRST “IMPERIAL METEOROLOGICAL REPORTER” WITH CALCUTTA (now KOLKATTA) AS HEADQUARTER. PARALLEL OBSERVATIONS WERE ALSO HAVE BEEN FOUND TO BE RECORDED SINCE 1841 IN BOMBAY PRESIDENCY IN COLABA, BOMBAY (now MUMBAI). A TEMPORARY BRANCH OFFICE IN THE PREMISES OF TELEGRAPH OFFICE, SHIMLA WAS OPENED IN 1875. NAGPUR CITY OBSERVATORY CAME INTO EXISTENCE ON 01.01.1869 IN THE PREMISES OF MAYO HOSPITAL.
Mr. BLANFORD RETIRED ON 8th MAY 1889 AND HANDED OVER THE CHARGE TO Mr. JOHN ELIOT. ON 01st APRIL 1899, THE DESIGNATION OF IMPERIAL REPORTER WAS CHANGED TO “DIRECTOR GENERAL OF OBSERVATORY”. IT WAS DECIDED IN 1905 TO MAKE THE SIMLA OFFICE AS THE HEAD-QUARTER AND CALCUTTA OFFICE AS THE BRANCH OFFICE. DUE TO OPERATIONAL REQUIREMENTS, THE SIMLA OFFICE (1916) WAS SHIFTED TO POONA (now PUNE) IN MARCH 1928. A FORECASTING CENTRE WAS OPENED IN DELHI IN 1929 AND SHIFTED TO PRESENT LOCATION ON LODHI ROAD, NEW DELHI-3 ON A 30-ACRE LAND IN 1940.
FOR SMOOTH RUNNING OF THE Met. DEPARTMENT, 7 REGIONAL METEOROLOGICAL CENTRES WERE ESTABLISHED IN 1945 AND WERE LOCATED IN BOMBAY, CALCUTTA, DELHI, KARACHI, LAHORE, MADRAS AND NAGPUR.
CENTRAL OBSERVATORY AT ALIPUR WAS THE FIRST OBSERVATORY IN INDIA TO IMPART TRAINING TO THE OBSERVERS, TO TEST THE INSTYRUMENTS AND STANDARDIZE FOR TAKING SEVERAL TYPES OF OBSERVATIONS.
A ‘NEWMAN BAROMETER’ WAS INSTALLED AT ALIPUR OBSERVATORY AND WAS USED AS A STANDARD BAROMETER. TWO OTHER BAROMETERS FOR SECONDARY USE WERE KEPT IN ALIPUR OBSERVATORY AND ARE STILL IN USE SINCE 1877.
A ‘DINES PRESSURE TUBE ANEMOGRAPH’ (DPTA) WAS INSTALLED AT ALLAHABAD IN 1895. A SHED FOR THERMOMETER WAS MODIFIED IN 1921 AND WAS CALLED AS ‘STEVENSON SCREEN’ AND ANEMOMETERS AND WIND VANES WERE MOUNTED ON ROOF TOP. CONTINUOUS RECORDS OF TEMPERATURE, PRESSURE, HUMIDITY, WIND DIRECTION AND SPEED AND RAINFALL IS AVAILBALE (OF SOME PALCES) SINCE 1871. UPPER AIR OBSERVATIONS USING BALLOONS STARTED IN 1877 WHICH FURTHERE IMPROVED WITH THE HELP OF KITED WERE MEASURED CARRYING METEOROGRAPH IN 1905. PRESENTLY IMD PROVIDES SERVICES RELATING TO METEOROLOGY, SEISMOLOFY AND ALLIED SUBJECTS TO DIFFERENT SECTORS AS FOLLOWS (See picture below):-

DENSE FOG, CHILLY WEATHER CONTINUES UNABATED AND THE COLD WEATHER CONDITIONS ARE INTENSIFYING IN PARTS OF ASIA.
ON JANUARY 07th 2011, DELHI(4.3) WAS COLDER THAN SHIMLA(5.5).
THE SOUTHWARD JOURNEY OF THE MERCURY CONTINUES AND MANY PLACES IN THE MAINLAND OF MADHYAPRADESH RECORDED SUB-ZERO TEMPERATURES. IN REWA 44-YR OLD RECORD WAS BROKEN AND IN RAICHUR (KARNATAKA) 120-YR OLD RECORD WAS BROKEN.
THE NIPPY WEATHER CONDITIONS LEAD TO FOG AND MIST AFFECTING NORMAL LIFE, BEING THROWN OUT OF GEAR. ROOM HEATERS AND FOR THE LESS PRIVILEGED BON-FIRES ARE A COMMON SIGHT.
THE GUANGXI WEATHER BUREAU IN CHINA HAS WARNED ABOUT INTENSE COLD WAVE IN CENTRAL AND SOUTH CHINA. MILLIONS OF LIVES ARE PARALYSIED DUE TO SLEET AND SNOW, THE NATIONAL HIGHWAYS AND AIRPORTS BEING CLOSED. ITS CASCADING EFFECT IS SHORTAGE OF FOOD SUPPLIES AND PRICE RISE AND SCHOOLS AND COLLEGES BEING CLOSED OWING TO SAFETY CONCERNS.
IF THERE IS NO RELIEF FROM SUCH FREEZING WEATHER, THE ESSENTIAL SUPPLIES, WATER AND ELECTRICITY MAY BEAR A COLD SNAP. THE RESULTING FINANCIAL LOSSES MAY BE IN MILLIONS OF DOLLARS. THE BONE PENETRATING COLD WAVE MAY LAST FOR ABOUT A WEEK MORE, ACCORDING TO IMD. AND WE WILL HAVE TO BEAR THE BRUNT OF WEATHER, BECAUSE WE DO NOT HAVE ANY COLD WAVE RISK MITIGATION PLANS AND THE VAGARIES OF WEATHER WILL CONTINUE TO SHOW ITS UNPRECEDENTED CALAMITY.

MEANWHILE, NAGPUR WEATHER OBSERVATORY, ESTABLISHED ON 01.01.1869 AT MAYO HOSPITAL AS A CLASS-IV-B OBSERVATORY AND SHIFTED TO PRESENT SITE ON 19.04.1948 AS A CLASS-I OBSERVATORY RECORDED TODAY ON 07th JANUARY 2011 A MINIMUM TEMPERATURE OF 5.7 DEG CEL, THE SECOND LOWEST TEMPERATURE IN THE HISTORY. INCIDENTLY TODAY IN 1937 THE LOWEST EVER MINIMUM TEMPERATURE WAS RECORDED AS 3.9 DEG CEL. AND TOADY LAST YEAR IN 2010 WAS THE COLDEST DAY OF THE RESPECTIVE SEASON. IN NAGPUR. ON FIVE OCCASSIONS IN THE PAST DECADE i.e. IN 2001,2004,2007,2008,2009 THERE WAS NOT A SINGLE DAY IN JANUARY WHICH COULD SEE A TEMPERATURE DROP EVEN UPTO 8 DEG CEL
IF WE FURTHER CONTINUE TO WITNESS THE ONSLAUGHT OF WINTER,  WE MAY HAVE TO ISSUE A SEARCH WARRANT FOR GLOBAL WARMING TO EXTEND ITS GRATITUDE TO GIVE US MUCH NEEDED RESPITE AND WARMTH.

INDIA’S PRIDE ‘CIRUS’ SHUTDOWN

THE CIRUS REACTOR WAS SHUT DOWN PERMANENTLY ON FRIDAY MIDNIGHT i.e. ON 31st DEC 2010.
THIS 40 MW REACTOR, OPERATING AT A CAPACITY FACTOR OF 50-80% WAS PRODUCING 6.5-10.5 Kg OF PLUTONIUM PER YEAR AND USED NATURAL URANIUM FUEL WHILE USING HEAVY-WATER(DEUTERIUM) AS A MODERATOR (a medium that reduces the speed of fast neutrons and turning them into thermal neutrons which are capable of sustaining a nuclear chain reaction) PLAYED AN IMPORTANT ROLE IN THE FIRST NUCLEAR TEST IN POKHRAN-I (codenamed SMILING BUDDHA) IN 1974.
THE FIRST NUCLEAR CHAIN REACTION (CRITICALITY) WAS ATTAINED ON 10th JULY 1960.
THE CIRUS (CANADA INDIA REACTOR UTILITY SERVICES) WAS AN ICONIC SYMBOL OF INDIA’S INDIGENOUS NUCLEAR POWER PROGRAMME FOR CIVIL AND MILITARY. THE PLUTONIUM FROM ITS SPENT FUEL WAS USED AS A PART OF STRATEGIC NUCLEAR POWER PROGRAMME OF THE DEPARTMENT OF ATOMIC ENERGY. THE BARC (BHABHA ATOMIC RESEARCH CENTRE) MAINTAINS THAT URANIUM FUEL WHICH IT PROCURED INDEGENOUSLY HAS BEEN FULLY UTILISED BY SLOWLY DRAINING OUT OF HEAVY WATER IN THE MODERATOR. HOWEVER, THE PUMPS STILL CONTINUE TO RUN TO REMOVE THE DECAY HEAT AND ALL OTHER PROCESSES TO REMOVE THE RESIDUAL HEAT FROM THE CORE FO THE REACTOR WILL BE KEPT OPERATIONAL FOR SOME MORE TIME, PROBABLY UPTO ONE YEAR. AFTER DECONTAMINATION, THE REACTOR WILL NOT BE DEOMMISSIONED AND WILL BE USED FOR STUDENTS’ TRAINING. ALSO A PLAN TO CONVERT IT INTO A NEUTRON PRODUCING SYSTEM FOR SUB-CRITICAL EXPERIMENTS IS ON THE ANVIL. THIS FIFTY YEAR OLD NUCLEAR REACTOR, COULD HAVE LIVED FOR TWENTY MORE YEARS, WAS SHUT DOWN IN SEPTEMBER 1997, REFURBISHED, AND RESUMED IN 2005(SCHEDULED TO RESUME IN 2003), BEFORE PERMANENTLY SHUTTING IT DOWN.

THE COINS OF VALUE DENOMINATION 1-(ONE) PAISE, 2-(TWO) PAISE, 3-(THREE) PAISE, 5-(FIVE) PAISE, 10-(TEN) PAISE, 20(TWENTY) PAISE AND 25(TWENTY-FIVE) PAISE WILL NO LONGER BE A VALID DENOMINATION.

EVEN THOUGH THESE COINS VANISHED LONG TIME AGO, WHATEVER COINS WERE MINTED AND WERE IN CIRCULATION WILL NOT BE ACCEPTED IN TRANSACTIONS. THE MINTING OF THESE COINS WAS STOPPED BECAUSE; THE COST OF MINTING THEM WAS MORE THAN THEIR FACE VALUE. NOW THE GOVERNMENT OF INDIA HAS DECIDED TO WITHDRAW THEM FROM CIRCULATION ALTOGETHER AND WILL CEASE TO BE A LEGAL TENDER IN THE COUNTRY AND THE MINIMUM DENOMINATION COIN THAT WILL BE ACCEPTED AS A LEAGL TRANSACTION WILL BE 50-(FIFTY) PAISE COIN. ALSO THESE DENOMINATIONS (1,2,3,5,10,20,25 PAISE) WILL NOT BE ACCEPTED FOR PAYEMNT ON ACCOUNT i.e. THE ENTRIES IN BOOKS OF ACCOUNTS, PRICING OF PRODUCTS, TAXES, SERVICES ETC. WILL BE ROUNDED OFF TO FIFTY PAISE OR WHOLE RUPEE FROM THE DATE THE PROCEDURE FOR CALL-IN WOULD BE NOTOFIED BY THE RBI. THE FINANCE MINISTRY HAS REALLY WIPED OUT WHATEVER LITTLE VALUE THESE COINS HAD. NOW NOBODY CAN CALL AS ‘CHAVANNI CHAAP’; AS THIS WILL ALSO BECOME HISTORY.
