Seventh Pay Commission


Shri.Ajay Maken, Union Minister has recently addressed a letter to Prime Minister for early setting up of Seventh Pay Commission.
The following is the full Text of Letter dated 14th March, 2013 to Prime Minister by Shri Ajay Maken, Union Minister regarding request to early setting up of Seventh Pay Commission.:--->
It is with a sense of pride that I seek to underline that about 3,2 million Central Government Employee and an equal number of pensioners inducting service personnel, hold you in high esteem and think of you as one amongst them. They look up to you as a leader who would not only empathize with their concerns but ensure deliverance as well. It was you who had constituted the Sixth Central Pay Commission (CPC) in 2005 which should have been set up in 2003 by the NDA Government.
2) Central Government Employee who are inducted in Government through a process of rigorous screening and testing as also stringent evaluation of a job performance are supposed to be the brightest. With globalisation and multi-national corporation coming into the country, we have at hand a two fold challenge:
(a) do have a personnel pool with high acumen to deal with these MNCs,
(b) simultaneously a dress the challenge of high attrition on which in itself is a result of MNCs having come in. In order to attract as also retain the brightest minds in Government employment it is but necessary that Central Pay Commission are set up regularly to look into and evaluate their pay structures and submit recommendations.
3) Ever since the setting up of the second Central Pay Commission all pay commissions have been set up in the 3rd year of every decade baring the one time when the NDA Government did not do so in the year 2003. The pay commissions are then required to submit their recommendations/reports in three years time. However, you had set up the sixth pay commission in 2005 and submitted its report in an year and half, much to the relief and succour of Government employees. We are again in the third year of the on-going decade and Central Government Employees are justifiably looking forward to the Seventh Pay Commission that would look into their needs. The present wage structure of the Central Govt. Employees has been made on the basis of the Sixth Central Pay Commission’s recommendations, which were implemented with effect from 11.2006 in the case of Pay and in the case of allowances with effect from 1.9.2008. The erosion of real wages owing to the degree of inflation in the economy is hurting these employees very badly. The retail prices of those commodities, which go into the making of minimum wage, have risen by about 160% between 1.1.2006 to 1.1.2011, in comparison to D.A. compensation, which on that date had been just 51%. It is also an acknowledged fact that the 6th CPC had computed the minimum wage by suppressing the retailprice of these commodities in the market on the specious plea that official statistics of the retailprices of these commodities were not available. They therefore, computed the retail price by increasing the wholesale price by 20% for each of the commodity whereas the actual retail price in the market was 60% more than the wholesale price.
4) Broadly, one’s -emoluments should be adequate enough to commensurate with boundless and limitless assignments and to his duties and responsibilities in a better, effective and honest manner. The same has also to place, an employee to be in a position to fulfil his social and family obligations, such as education of children, their marriage, maintenance of a reasonable living standard for himself and his family members expected of Government servants and also to take care of his post retirement life.
5) The basis of fixing wages in the past was largely a consumer need related, which was considered at a bare minimum like the minimum nutritional level, minimum clothing, housing etc. But today life is more complex and living standards are not based on simple living and the same cannot be restricted to only for the working class. The producer of wealth being the consumer oriented also requires consumers, including the Central Government employees.
6) These employees are also placed in a disadvantageous situation vis-a-vis their counterparts in Central Public Sector undertakings, in whose case, the wage revisions normally takes place after every five years through Collective bargaining. The wage revision of the Central Government employees if not after five years it must be after every ten years and the Government needs to consider setting up of the Seventh Centra1 Pay Commission immediately. While conceding the fact that the Central Pay Commission is founded only in every 10 years, however with the coming of the year 2011, prices of most of the products needed in day to day life is increasing.
7) In brief the following decision need to he taken on Priority so that a positive message goes among serving Central Government Employees, Pensioners and Service and Para Military Personnels, the decision will also have bearing upon State Governments Employees:- A notification for constitution of 7th Central Pay Commission is the need of the hour, which is bound to have bearing upon about 20 million employees, which are opinion makers. Therefore the issues may please be considered by the concerned Ministries on Priority and appropriate decision is taken.
Sir, I will be extremely obliged if the above submission is considered favourably in larger interest of government employees as well as the party.

DEPARTMENT” TO BE ANSWERED

(a) Yes Sir. The weather forecasting systems in the country are comparable to most of
the countries in the world with respect to rainfall forecasting. Efforts are being made
to optimize the level of efficiency of the forecasting systems.
(b) Yes Sir. Earth System Science Organization (ESSO) - IMD has already implemented
Phase-I of the Modernization during 2007-12.
(c) Under the Phase-I of the modernization of ESSO - IMD, the following state-of-the-art
systems were commissioned:
• Observing systems such as Automatic Weather Stations (AWS), Automatic Rain Gauges
(ARG), Doppler Weather Radars (DWR) etc.
• Monitoring/early warning systems
• Analysis-visualization-product dissemination systems
• High Performance Computing (HPC)
• Communication/IT systems
• Real-time data assimilation-forecast systems etc.
Further, several manual operations have been fully automated. All the scientific staff
engaged earlier have been provided due training to develop appropriate skills for
customization of sector specific (like agriculture, aviation etc.) warning and forecasting
services.
In order to capture the characteristics of the severe weather in real time, 24X7
monitoring system comprising 675 Nos. of AWSs; 1024 Nos. of ARGs; 17 S and
C-Band DWRs have been commissioned at Chennai, Sriharikota, Machilipatnam,
Visakhapatnam, Kolkata, Mumbai, Bhuj, Hyderabad, Nagpur, Patiala, Delhi Palam,
Lucknow, Patna, Mohanbari, Agartala, Delhi Lodi Road and Jaipur. Only DWR at Bhopal
is under commissioning.
High Performance Computing (HPC) systems have been used to enhance the weather
forecasting capacities by assimilating all available global satellite data for forecast
generation. The global model that was earlier run at 50Km grid scale are now run at
22Km grid. The regional scale model run earlier at 27Km grid is replaced by 9Km and
3Km grid scale models. The accuracy of short range (up to 3-days in advance) monsoon
forecasts has improved from 50-60% to 70-95%. The skill of district level medium range
rainfall forecast (up to 5-7days in advance) has improved from 60-70% to 75-85% in
monsoon season and from 70-75% to 85% in non-monsoon seasons.
As far as the track and landfall forecasts of the tropical cyclones are concerned, the
performance evaluation of the updated forecast systems for the past 5-years, have
demonstrated enhanced forecast skill by about 18%. ESSO-IMD currently operates 5- Doppler Weather Radars (DWR) at Chennai, Machilipatnam, Visakhapatnam, Kolkata, Sriharikota
on the east coast along with a network of Automatic Weather Stations (AWS) and
Automatic Rain Gauges (ARG) for continuous weather surveillance over the Bay of Bengal.
ESSO-IMD has operationalized its location specific nowcasting (near real-time) weather
service for severe weather (Thunderstorms; heavy rainfall from lows/depressions over
the land) across the country. This service activity currently covers 117 urban centres on experimental basis under which nowcast of 3-6hour range is issued. Origin, evelopment/
movement of severe weather phenomena are regularly monitored through DWRs and
with all other available observing systems.
Integrated Agro-meteorological Advisory Service (AAS) is rendered now on twice-weekly
 basis in collaboration with State Agricultural Universities (SAUs), institutions of Indian
Council of Agricultural Research (ICAR), etc. District level weather forecast for next
5-days in respect of:
• Rainfall
• maximum temperature, minimum temperature,
• wind speed, wind direction,
• relative humidity and clouds
• weekly cumulative rainfall forecast
are provided. Further, crop specific advisories to help the farmers are issued and
widely disseminated. The AAS of ESSO-IMD has been successful in providing the crop
specific advisories to the farmers through different print/visual/Radio/ IT based
media including short message service (SMS) and Interactive Voice Response Service
(IVRS) facilitating for appropriate field level actions.

Subject: – Simplification of Pension Procedure- Amendment in para 15 and para 16 of “Scheme for payment of pensions to Central Govt. Civil Pensioners by Authorised Bank”.
Attention is invited to the provisions contained in paras 15 and 16 of the Scheme Booklet regarding submission of life & other certificates and inter bank /intra bank transfer of pension Account.
2. Keeping in view the need to make the process of submission of certificates user friendly and in line with the technological advancement in the banking industry, it has been decided to allow pensioner/family pensioner to submit the life certificate as well as other certificates to any branch of the Bank through which his /her pension/family pension is being disbursed.
3. Further with the introduction of CBS and implementation of CPPC, the pensioner/family pensioner who is desirous of transferring his/her pension account from one branch to another branch (whether local or out station) of the same bank should has the option of putting in his/her request at either of the two branches instead of the present dispensation wherein transfer request is entertained only at the home branch. The transfer application will require mentioning both account numbers (in the old & new branch) with both branch contact details. The branch receiving the application will scan and register the same to CPPC. CPPC will coordinate the continuity of disbursement of monthly pension/family pension without any break.
4. All banks are hereby directed to follow the above procedural modifications in pension process and issue necessary instructions to all concerned accordingly.
5. This issues with the concurrence of Department of Pensions & Pensioners Welfare, Ministry of Personnel, Public Grievances & Pensions and Department of Expenditure, Ministry of Finance.

THE NAGPUR SKIES ARE EXPECTED TO BE PARTLY CLOUDY TO MAINLY CLOUDY FROM 23rd JAN 2013 AND WILL CONTINUE TO BE SO TILL THE WEEK END.
A FEW DROPS OF RAIN IS ALSO EXPECTED FROM THE MID-NIGHT OF 23rd JAN, WHOLE DAY ON THE 24th JAN, WELL BEYOND MIDNIGHT TILL 25th JAN 2013, EVEN THOUGH THE AMOUNT OF RAINFALL WILL BE VERY LESS/TRACE, ALL OWING DUE TO WD.
THE MIN TEMPS WILL SHOW A RISE OF ABOUT 06 DEG BIT BY BIT THROUGH THE WEEK END WHERE AS THE MAX WILL RISE BY ABOUT 03 DEG ONLY.
THE GROUND WINDS HOWEVER WILL BE IN THE RANGE OF 12-15 Kmph AND WILL BE MOSTLY SWly TO Sly TILL MONDAY JAN THE 28th, 2013.

Our Advocate was ready for argument but the standing counsel for respondent pleaded that as he is new to this case, he needed some time to examine the case. The Hon’ble Judge asked him whether he can argue next day or within a week’s time. He pleaded that he needs more time for arguing the case. Meanwhile, the Office side apprised the Hon’ble Judge that the restructuring proposal pending with Ministry of Finance will be finalized within a month’s time or so. The Hon’ble Judge then gave 4th March, 2013 as the final date of hearing.

CAT Jabalpur CASE UPDATE


UPDATE AS RECD. FROM SHRI RIZWAN IS THAT NEXT DATE OF HEARING IS 04TH MARCH 2013.
THE OFFICE SIDE (GOVT.SIDE) WANTED MORE TIME AND THE HON JUDGE CAME TO THE CONCLUSION THAT  SINCE THE OFFICE HAS SHOWN ITS WILLINGNESS FOR IMPLEMENTING THE DASS COMM. REP., AND IT (OFFICE/MOES) WANTS SOME CLEARANCES FROM OTHER AGENCIES WHICH ARE NOT IN THE CONTROL OF IMD, THE COURT HAS GIVEN TIME TILL 04TH MARCH.
THIS MEANS THAT IF BY THIS TIME (04TH MARCH 2013) THE OFFICE DOES NOT GIVE/IMPLEMENT THE REPORT, THEN THE TIME BOUND PROMULGATION OF ORDER CAN BE MADE BY THE HON COURT. FURTHER OFFICIAL COMMUNICATION FROM CEC WILL BE AVBLE IN SHORT COURSE OF TIME.

HAPPY NEW YEAR 2013

THE YEAR 2012 WAS VERY TUMULTUOUS, RESTLESS AND TURBULENT, DISORDERLY AND DISTURBED FOR ME, BUT HAD IT NOT BEEN FOR GOD'S GRACE, IT WAS DIFFICULT FOR ME TO SEE THIS DAY.
HOWEVER, LIKE EVERY YEAR (FROM LAST TWO YEARS) THE YEAR END i.e DECEMBER The 31st WILL BE WARM, MAINLY TO PARTLY CLOUDY AND THE DAY OF THE NEW YEAR 2013 WILL BE GREETED BY HEAVENLY SHOWERS WHICH CONTINUE TO THREATEN THROUGH OUT THE NIGHT TILL EARLY MORNING OF 02nd JANUARY 2013.
THOUGH THE AMOUNT OF RAINFALL IS VERY LESS, THE FIVE DEG RISE IN MINIMUM TEMP(ON 2nd Jan. 2013)WILL MAKE IT COMFORTABLE, THE 03rd JAN 2013 WILL AGAIN SEE AN EQUAL DROP IN MIN TEMP AND SEE-SAW CONTINUES THROUGH OUT THE WEEK AT NAGPUR AND AROUND.

Sir,
As per the O, M’s referred above, all Departments should strictly comply a model calendar for DPC’s in order to ensure that DPC’s are convened in advance and approved select panels are prepared well before the commencement of the relevant vacancy years as per the time schedule prescribed therein. All Departments were also requested for strict compliance of the instructions so as to achieve the desire objectives of timely convening of DPC’s. Also as per DOPT O.M under Ref 3 , the Administrative delays in holding of  DPC’s has  been viewed adversely by various courts and is the main reasons for litigation before Hon’ble CAT and various High Courts.
Therefore, in the light of the above ref O.M’s of the DOPT, You are kindly requested to provide me the following information under section 19 of the RTI ACT 2005.on priority basis:-
  1. As per the DOPT O.M No ref at S.No 1, All department were advised to nominate  an officer of the level of J.S  as designated  authority for ensuring timely holding of the DPC’s  and to certify the adherence to the model calender of all DPC’s. So kindly provide  me the Name and designation of an officers nominated for IMD as per DOPT’s Order. Also, kindly provide the certified copy of order issued for the same.
  2. Kindly provide the year wise vacancies in the cadre of AM-II, AM-I and Met-I Cadres during 2000 to 2012 (13 years).
  3. Kindly provide me the dates of all the DPC’s held during 2000 to 2012 for  cadres of AM-II, AM-I and Met-I cadres . Also ,kindly the certified copies of the minutes of all the DPC’s held during 2000 to 2012.
  4. Kindly provide me detailed information of all the years( during 2000 to 2012) in which DPC’s were held  two times as per the time frame of the MODEL CALENDER of the DPC’s guided by DOPT in the cadres of AM-II to Met-I.
  5. Kindly provide me detailed information of all the years ( during 2000 to 2012) in which DPC’s were not held in the AM-II, AM-I  and Met-I as per the time frame of MODEL CALENDER of the DPC’s guided by the DOPT.
  6. Kindly provide the names and designation of all the officers who are responsible for non compliance of DOPT O.M’s referred above in ref 1, 2  and 3 and mentioned in Point no 05.
  7. As per DOPT O.M.No  Ab-14017/35/2011-Estt (RR) dated 23.09.2011 Point no5, officers with qualifications M.Sc(Maths, IT, Stat,operational research and total quality management) or MCA  are not eligible for MFCS. So kindly provide the names of all officers of IMD having M.Sc (Maths, IT, Stat, operational research and total quality management) or MCA qualifications.
  8. If the officers with above referred qualifications in IMD are promoted under MFCS,Kindly provide the certified copy of GOI Order for the same with file noting (if any).
  9. If there is no such order, kindly provide the names and designations of officers who are responsible for invalid/illegal promotions procedure in violation of DOPT orders.

Therefore , you are kindly requested to provide me all above information along with certified copies of all file noting involved  and if any point is not related to you kindly transfer that point to concerned authority with intimation to me under section 6(3) of the RTI ACT 2005.
